COIDA – All you need to know ….

If your employee gets injured on duty, do you know what your obligations as an Employer regarding COIDA are?

The Compensation for Occupational Injuries and Diseases Act, No 130 of 1993 (COIDA) provides for compensation for incapacity caused by occupational injuries or diseases which are sustained or contracted by Employees in the course of their employment, or for death resulting from such injuries or diseases.

As an Employer, if you are unsure whether you are should register with the Compensation Fund, its important for you to know that it is a statutory requirement that you do so from the moment you hire your first Employee. Should the Department of Labour visit your place of Employment, and they will… one of the first things that you will be required to do, is to provide proof that you have registered with the Compensation Fund. Employers who are registered are protected against civil claims in this regard. The Compensation Fund basically prevents employees covered by the Act from suing their employers for damages in terms of common law.

In order to register for Compensation, you will need to complete the W.As.2 form and submit the completed form to the Department of Labour. Employers can download the forms on the Department of Labour’s website. In order to complete your registration correctly, copies of the following documentation should be included

1) The registration certificate from the Register of Companies if they are a company or closed corporation,

2) Or their ID document, if they are sole owners of the business.

Employers are required to submit a Return of Earnings (ROE) form (W.As.8) on an annual basis. The Department of Labour has announced that the 2017/2018 submissions will open on 1 April 2018 until 31 May 2018.
