Amendments to the Employment Equity Act, No 55 of 1998 (EEA) came into operation on 1 August 2014.

Read the guidelines below to determine if your company is a designated Employer.

The Employment Equity Act applies to all employers, workers and job applicants, but not members of the –
  • National Defence Force;
  • National Intelligence Agency; and
  • South African Secret Service.

The provisions for affirmative action apply to –

  • employers with 50 or more workers, or whose annual income is more than the amount specified in Schedule 4 of the Act (table below);
  • municipalities;
  • organs of State;
  • employers ordered to comply by a bargaining council agreement;
  • any employers who volunteer to comply.

All employers who employ more than fifty employees, or have an annual turnover higher than the amount identified in Schedule 4, are required to submit the report annually.
